Do you know what to do if you are involved in a traffic accident in Spain?
We will explain you which steps you have to take if you are involved in a car accident in Spain.
First thing to do it is to keep calm and confirm which are the damages and in which way people have been implicated in the accident: drivers, car´s occupants, pedestrians, etc; you should call the Emergency Services number 112 (free call from Spanish telephone), whether someone has been damaged.
If nothing serious has happened and nobody is injured, and there are only material damages (just the cars), the drivers involved can signed the DECLARACION AMISTOSA ACCIDENTE DE TRAFICO, – form that your car insurance company is given you with your car insurance-, that you and the other driver should fill and sign stating the accident’s circumstances.
One of the most important things that you need to check is that all the details are completed, as the full addresses, telephone numbers, car insurance policy numbers and insurance company details, identification numbers, etc.
Make sure that you explain all the important details of the accident in this REPORT you are signing, who is the person responsible of the accident, how the accident has happened, where the accident was, all the material damages to the cars and to other elements, like for example: street lights, road signals, etc.
You have to notify the accident to your insurance company and send to them the report signed the same day it happens or the next one.
Another thing to keep in mind is to not forget to keep all the invoices for any kind of service you need to use because of the accident, like tablets, medicines, garage bill, taxi, etc. in case you can claim for them back.
If something more serious happened in the accident and someone has been injured, you should call the emergency number 112 and they will call the Police or Guardia Civil, which will make an official report (ATESTADO) where they will describe how the accident was, the consequences of it, who is the person responsible for it, etc.
In those cases, this document from the police is, really, one of the most important ones, so make sure, if you can, that the police are fully aware of all the pertinent details and help them explaining the most clearly and calmly all the details about the accident.
